Even with the most careful preparation and planning of activities and equipment, we can not exclude every risk.
In order to give all participants an unforgettable and carefree experience, we kindly ask you to carefully read and observe the following information:

1. Contract

 

These terms and conditions govern the legal relationship between the customer and Bike Base S.L. for all services provided by us. The regulations apply to activities from the official program as well as to individually agreed activities. 

The activities are carried out by Xplore-Planet, which is a department of Bike Base S.L.

2. Terms and conditions

 

The person making the booking is responsible for all contractual obligations for the participants registered by him. Furthermore, he is responsible for the transmission of all information (such as terms and conditions, schedule, location, level of difficulty, physical fitness requirements, other requirements such as minimum age, equipment required, etc.) to all other registered by him.

We refer to the necessary physical conditions for each activity description. Upon completion of the booking, the customer automatically confirms that he meets the physical requirements relevant to the activity. This also applies to other persons registered by him.

 

All participants in an activity undertake not to be under the influence of alcohol, drugs or other narcotics during the performance. For the participation of minors, who are not accompanied by the parents / guardians, the presentation of a signed consent or power of attorney as well as the copy of the passport / identity card of a parent is required.

 

The guide has the authority to interrupt or change the activity, if the resulting situations could be dangerous for the participants. Participants agree to follow the instructions of the guide. Failure to follow the instructions may result in suspension of activity, in which case there will be no refund of the payment.

 

Unless explicitly contradicted, participants agree that Bike Base S.L. photo and video recordings are used for promotional purposes. may be used. This does not apply to minors or otherwise not fully able to work.

 

If an activity is carried out by a third party provider, we explicitly point this out in the description of the service. Defect displays or similar in these cases are addressed directly to the third party.

3.   Registration and conclusion of contract

 

Registration

On the Xplore-Planet-website you can first choose from different categories of activities. By completing the additional information fields for yourself and other persons to be registered, as well as for payment and completion of the booking process by clicking on the corresponding button, you instruct us to provide the selected activity. The booking order is binding. Payment is due upon booking. Before completing the booking, the customer has the option of interrupting the booking process at any time in order to recognize and correct input errors.

 

Conclusion

By booking by clicking on the "Book" button or by telephone or e-mail (= offer) and the booking confirmation (= acceptance of offer) by Bike Base S.L., a contract between the customer and Bike Base S.L. closed. The booking made by the customer is considered as accepted by us at the time he has received the booking confirmation by E-mail. The General Terms and Conditions apply to all participants registered in a booking and are expressly confirmed by the customer upon completion of the booking.

 

Confirmation

The customer will receive by e-mail a booking confirmation containing the essential elements such as the description of the activity and the total price. If the customer does not receive a confirmation email within 24 hours of completing the booking, they should contact us directly at booking@xplore-planet.com.

4.   Services

 

For the services to be provided only our own publications (homepage, brochures, advertisements, etc.) are authoritative. Third-party publications or offers are not part of the contract, we are not liable for the information contained therein.
The participant of the activity undertakes to pay the agreed price for the activity and to comply with the terms of payment.

 

Transfer:

 

Included in the price is the transfer from / to the agreed pick-up location to the activity, within the transfer zone between:

Estepona (Hotel Fuerte, Arroyo Vaquero Playa Ctra A-7 KM 150, 29680 Estepona, Málaga)
and Marbella
(Don Carlos Leisure Resort & Spa, Avenida Zurita, s / n, 29604 Marbella, Málaga)

Pick-up locations outside of these zones must be requested separately and may be offered for an individually agreed surcharge.

5.   Prices

 

All prices include VAT. Individually calculated prices apply for individually requested activities. We will gladly inform you on request.

 

6.   Payment

 

The total price is due immediately upon completion of the booking. The payment can be made as follows:
- PayPal
- Credit card
- Direct Deposit
In the case of direct transfer, the customer must send a proof of payment (photo, copy etc. of the transfer) by e-mail (booking@xplore-planet.com) to Bike Base S.L..

A non-timely payment entitles us to refuse the service.

7.   Cancellation conditions / Rebooking

 

The following amounts are in the event of cancellation by the customer to Bike Base S.L. due:

• Cancellations from the day of reservation:     5% of the total price

• Cancellations from the 10th day before activity:   30% of the total price

• Cancellations from the 3rd day before activity:   50% of the total price

• Cancellations from 24 hours prior to activity: 100% of the total price

 

Cancellation conditions for individual reservations/ bookings:

• Cancellations from the day of reservation:   10% of the total price

• Cancellations from the 10th day before activity:   30% of the total price

• Cancellations from 48 hours prior to activity: 100% of the total price

 

If due to illness participation is not possible, we will refund the sick person the full amount on presentation of a medical certificate. Furthermore, there is the possibility of naming a substitute person, as long as this fulfills the necessary requirements and prerequisites for the activity. In this case, there are no additional costs.

 

If a tour is canceled due to force majeure (weather, natural disasters, political unrest etc.) on site, the Bike Base S.L. an alternative date proposed. If the customer can not take this, we will refund the payment made. Further costs resulting from the cancellation, such as travel, accommodation or other expenses etc. will be reimbursed by Bike Base S.L. not.

 

For our activities there is a minimum number of participants of 4 persons. If this number is not reached, we reserve the right to cancel the activity until 2 days before the start of the activity. All payments made will be refunded.

 

8.   Program change

 

Unforeseen circumstances may make it necessary, in the interests of the participants, to change the proposed program or individual components.

9.   Liability

Damage to property:

Each participant is responsible for the damage caused to him by third parties and material.

Activities with increased risk:

Our activities are sports adventure activities. Each participant exercises these at their own risk. In no event shall we be liable for any accidents or bodily harm resulting from the activities we offer, even if the participant is traveling in a group with a guide. The participant is responsible for compliance with the local road traffic regulations, even if he is traveling in a group with a guide. In our bike tours and canyoning tours wearing a helmet is mandatory.

10. Complaint / Claims

 

Should there be any reason to object during the activity by failing to meet the booked services, the customer is obliged to immediately and directly report this to the guide or the Bike Base S.L. to report and demand immediate relief.
Unless we offer an adequate solution within 48 hours, the customer is entitled to remedy the defects himself. The resulting costs will be replaced within the legal and contractual liability against evidence.

Any compensation claim that has arisen must be made in writing to the Bike Base S.L. immediately, at the latest 30 days after the agreed activity. to judge. Failure to comply with this condition invalidates any claim for damages.

11. Data protection

 

Customers of Bike Base S.L. have the right to access, rectify, cancel and object to their personal data at any time by sending a message to info@xplore-planet.com.

12. Jurisdiction

 

The Bike Base S.L. activities carried out are subject to Spanish legislation.
If the user does not have a general place of jurisdiction in Spain or another EU member state, if he is a merchant or relocates his permanent residence abroad after these Terms and Conditions or if his domicile or habitual residence is not known at the time the complaint is filed, the exclusive place of jurisdiction is Malaga.
